The National Credit Act was established to provide debt relief to the millions of South Africans who are over indebted and cannot make their monthly repayments. The Act also makes provisions to ensure that credit institutions and credit providers are transparent and do not behave in a reckless manner. This means that all credit agreements must be written in language that is easy to understand and that all clauses pertaining to interest charged or other fees that must be paid are clear and transparent. A credit provider that adheres to all the provisions of the Act can not be held responsible for the reckless spending of a consumer. At the same time, a credit provider who does not follow these provisions will be deemed reckless and severe fines and penalties will be enforced.
